Copyright protection for furniture design
An architect approached ATTYS with the question of whether a piece of furniture he had designed could be protected by copyright. After examining the professional licenses for architects, we came to the conclusion that architects are allowed to design and sell furniture, but that they are not allowed to manufacture it themselves without an appropriate partnership with a carpenter. In the next step, we analyzed the appropriate protection options for the furniture: Furniture can enjoy copyright protection if it has the required level of design by distinguishing itself from other products of a similar kind through its individual character. In addition, a piece of furniture can also be protected as a design if it is new and unique.
Media law advice on naming in the press
A former executive of an insolvent group of companies contacted ATTYS after his name was published without his consent in several articles in connection with the company’s insolvency. The right to anonymity derives from the general right of personality under Section 16 of the Austrian Civil Code (ABGB), whereby naming a person violates their right of personality if it impairs their interests worthy of protection. Our experts analysed the legal prospects of a lawsuit against the media company, weighing up the freedom of the press against the protection of personality rights. Since the client, despite his professional proximity to prominent personalities, was not a public figure himself and had deliberately remained in the background, we developed a strategy to strengthen his legal position. Protection of personality rights in the case of unauthorised use of photographs
A married couple commissioned ATTYS after discovering that their wedding photos had been used without their consent on the website of the event location for advertising purposes. The use of a person’s image for advertising purposes violates Section 78 of the German Copyright Act (UrhG) if the person depicted is thereby exposed to the suspicion that they have made their image available for advertising purposes in return for payment. Our lawyers identified violations of both copyright and data protection provisions and sent coordinated warning letters to the photographer responsible and the event venue. In addition to the immediate removal of the images from the website, we asserted claims for information and damages, as wedding photos enjoy special legal protection as particularly intimate moments in a couple’s life. Through our decisive action, we were able to successfully enforce our clients’ personal rights and obtain appropriate compensation for the infringement suffered.
