Law Meets Pitch: Mini-Moot-Court Sports Law
On 20.03.2025, an extraordinary event took place at WU Vienna that combined sports law with sporting ambition: Under the title “Law Meets Pitch,” students of Business Law from ELSA WU Vienna competed against each other in a mini-moot court – accompanied and moderated by attorneys from ATTYS Attorneys At Law. The highlight: the evening began in the lecture hall and ended at the Ernst Happel Stadium.
A Moot Court with Sporting Flair
The format was as innovative as it was practice-oriented: In teams of four, participants competed in a round-robin format for victory. The case to be argued addressed a highly topical sports law issue concerning freedom of movement for workers in professional football – based on real legal questions that have already engaged the European Court of Justice.
The scenario: In the fictional “Austrian Premier League,” a new regulation is introduced stipulating that at least 50% of players fielded must have continuously resided in Austria for the past three years. Belgian striker Wout van der Uden claims his rights are violated, while FC Alpenland Innsbruck argues in favor of promoting domestic football. The teams had to represent both positions – first one side, then after switching roles, the opposing position.
Event Schedule
Following an introduction at 5:00 PM, the teams began with their prepared 10-minute oral arguments. The evaluation criteria were demanding: legal argumentation, persuasiveness, rhetoric, time management, and composed responses to targeted questions from the ATTYS attorney jury.
Particularly challenging was the second round: teams received a new short case, had to switch roles, and had only 25 minutes to prepare their counter-arguments. This exercise developed not only legal flexibility but also the ability to grasp different perspectives on a case.
From Theory to Stadium
Following the case resolution and prize presentation, the sporting highlight of the evening arrived: participating students received exclusive ÖFB national squad jerseys with special customization as a surprise. The group then headed to the Ernst Happel Stadium to conclude the evening with drinks, food, and a football match – a perfect combination of sports law and sports experience.
Where Sports Law Meets Employment Law
Football has long evolved from a sporting discipline into a significant global industry. International competitions, cross-border transfers, and increasing commercialization raise complex legal questions – particularly at the intersection of employment law, social security law, and EU law.
The mini-moot court vividly demonstrated how relevant employment and social security law issues are in the sports context: from freedom of movement for workers to anti-discrimination provisions to contractual design questions. For the students, it was a valuable opportunity to apply their university knowledge in a simulated yet realistic setting and gain first-hand experience in argumentation before a professional jury.
Knowledge Transfer and Networking
